Who chooses the title company?
In Florida, who customarily chooses the title company depends on what county the property is located in. For example, in Palm Beach County the seller typically selects the title company and pays the title insurance premium. But in some counties, such as Broward County, the buyer customarily chooses the title company and pays the title premium.
In every case, it is the contract that ultimately determines which party chooses the title company and pay the premium.
What is Title Insurance and why do I need it?
Title Insurance protects the financial interest of an owner or lender against losses due to title defects, liens or other matters associated with real property. Without the protection of title insurance, a homeowner may be in jeopardy of losing their investment due to hidden liens and encumbrances that could result in a claim against ownership.
